Subject-To and Seller Financing Closings
in Georgia
Creative financing lets investors buy without new bank loans, and lets sellers sell when a traditional sale won't work. It also carries real legal risk for both sides. We structure and close these deals so the documents, disclosures and title work protect everyone involved.
Subject-to transactions
The buyer takes title while the seller's existing loan stays in place. Key issues: the lender's due-on-sale clause, insurance on the property, how payments are made and verified, and what happens to the seller's credit if payments stop. We draft clear agreements and seller disclosures that address each one.
Seller (owner) financing
The seller acts as the bank: the buyer signs a promissory note and security deed in the seller's favor. We draft and record the loan documents and advise on terms. Owner-financed sales to people who will live in the home can trigger federal lending rules (Dodd-Frank/SAFE Act), so structure matters.
Wraparound mortgages and novation
We explain when each structure fits, what can go wrong, and how to document it.
We represent sellers, too
If you're the seller in a creative deal, we can review the terms and help you understand your risks before you sign.
